Terms of service
These terms cover the use of this website and set the defaults for how we work with clients. A signed proposal always takes precedence over anything written here.
01 Using this site
The content on pkstudio.com.ua is ours or used with permission. Read it, quote it with a link, share it. Do not scrape it, resell it or pass it off as your own. These fictional projects show how a marketing project could be presented. The brands, people, quotes, artwork and results are invented; they are not evidence of client work or promised outcomes.
02 Proposals and engagement
Work starts when you accept a written proposal that names the scope, the metric we are accountable for, the fee and the start date. Anything not in the proposal is a change, and we price it before doing it.
03 Fees and payment
- Retainers are invoiced monthly in advance; project work is 50% on signing, 50% on delivery.
- Invoices are due within 10 business days. Late payment pauses work after a written reminder.
- Fees are quoted excluding VAT where VAT applies.
- The minimum term is three months, then monthly rolling with 30 days’ notice either way.
04 Ad spend and accounts
Media budget is paid by you directly to the platforms. All ad accounts, analytics properties, domains and creative files are created in your name and remain yours; we hold access, never ownership. When we part ways, you revoke our access; there is nothing for us to hand over.
05 What we need from you
- Timely access to the accounts, data and people the proposal names.
- Approvals within five business days, or the timeline moves by the length of the delay.
- Accurate information about your products, claims and legal constraints.
- A single point of contact empowered to make decisions.
06 Deliverables and intellectual property
On payment, you own the deliverables made for you: pages, creative, copy and reports. We keep the right to reuse our methods, templates and know-how, and to describe the engagement in a case study once you approve the wording.
07 Confidentiality
Everything we learn about your business stays inside the team working on it and outlasts the contract. The same applies in reverse to our pricing, methods and internal documents.
08 Results
We commit to the work, the cadence and honest reporting against the agreed metric. We do not guarantee rankings, revenue or platform behaviour; nobody honest can. If the metric misses, we say so and recommend a change, including stopping.
09 Termination
Either side may end a rolling engagement with 30 days’ written notice. We may end it immediately for non-payment, unlawful instructions or abuse of our team. Work completed to the end date is invoiced; prepaid work not yet started is refunded.
10 Liability
Our total liability for any engagement is capped at the fees paid in the three months preceding the claim. We are not liable for platform policy changes, account suspensions we did not cause, or indirect losses. Nothing here limits liability that cannot be limited under Ukrainian law.
11 Governing law
These terms are governed by the laws of Ukraine. Disputes go first to a conversation, then to mediation, then to the courts of Kyiv. International clients may specify another venue in the proposal.
